08/31/09 North Park Business Park I consists of two office bldgs with a total of 119k SF, located in Omaha, NE. The occupancy is 100%. The loan was transferred to Special Servicing after the DBSI master tenant filed bankruptcy in Nov-08. Lender, DBSI and the TIC investors entered into a settlement agreement regarding the so-called silo funds and DBSI paid those amounts to the TIC investors, c/o lender. The lender has approved the TIC investors\' replacement manager and agreed to restructure terms. Lender discovered that one of the bldgs is in flood zone AE. The restructure will close after borrower obtains flood insurance, expected by 8/31/09.
